The Peoples Democratic Party, PDP and its presidential candidate, Atiku Abubakar cannot assess the Independent National Electoral Commission, INEC server the Supreme Court ruled on Tuesday.

The apex court’s judgment was upon the appeal launched by Atiku and the PDP for the commission to open up its server to authenticate their claim that they won the election by more than 1.6 million votes.

The Presidential Election Petition Tribunal had in its response to the application by the PDP declined the request to be granted access to the server. The PDP had upon that claim appealed to the Supreme Court for a reversal of the judgment.

A five-man panel of the Supreme Court, however, dismissed the application saying that the appellants failed to prove their case.

The panel chaired by Justice Datijo Mohammed, upheld the ruling of the Presidential Election Petition Tribunal that declined to grant the inspection request of the applicants.

Delivering judgement on Tuesday, on behalf of the other members of the panel, Justice Centus Nweze affirmed that the PDP and Atiku failed to prove their case.

“The Appellants failed woefully in this ill-adviced journey to this court”, he said as he dismissed the appeal as lacking merit.
