Why Buhari’s Educational Qualification Cannot Be Challenged – S/Court

A legal action challenging President Muhammadu Buhari’s educational qualification to stand for the presidential election was dismissed by the Supreme Court on the claim that the action was statute-barred.

The court upheld that the action was instituted well after the deadline for the commencement of such actions.

However, the Supreme Court jurists severely reprimanded government lawyers in the Federal Ministry of Justice for representing the president in the matter.

Three Nigerian citizens, Kalu Agu, Labaran Ismail and Hassy El-Kuris had filed the suit to challenge the president’s eligibility to stand for the election upon the claim that he committed perjury by claiming to have an educational qualification they claimed that he does not have.

They claimed that the president lied and committed perjury by lying about his educational qualification in Form CF 001 presented to the Independent National Electoral Commission, INEC.

The Supreme Court, however, upheld the ruling of the Court of Appeal that the action was vitiated by their failure to file their action within 14 days of the presentation of the form to INEC as stipulated by Section 285(9)

The apex court panel including Justice Dattijo and Justice Mary Odili nevertheless rebuked government lawyers for standing for President Buhari in a case they said was purely personal and private.
