Bayelsa Guber: S/Court Fines APC’s Lawyers N10 Million As It Dismisses Application For Review

For facilitating the appeal against the Supreme Court judgment that ousted David Lyon as governor-elect of Bayelsa State, the apex court on Wednesday directed counsels to the All Progressives Congress, APC, and Mr. Lyon to personally pay N10 million as fine to Governor Douye Diri.

The order came as the Supreme Court dismissed an application for review of the judgment which sacked Lyon and his running mate, Senator Biobarakuma Degi-Eremienyo from being sworn in.

The Supreme Court said its judgment of February 13 was final and for all ages and cannot be appealed.

Mr. Lyon and the APC were represented by Afe Babalola and Mr. Wole Olanipekun.

The Peoples Democratic Party, PDP was represented by Tayo Oyetibo who affirmed that the application by Lyon and the APC was dangerous as it was asking the Supreme Court to sit in appeal against its judgment.

He also affirmed that the APC could not have entered into the election without a running mate given the impairment of the candidature of Degi-Eremienyo as the running mate.

Justice Amina Augie who read the judgment dismissed the application for lacking merit as she said the counsels failed to point to any error in the judgment as delivered on February 13.

“There must be an end to litigation even if we review this judgment, every disaffected litigant will bring similar applications and the finality of Supreme Court judgments will be lost.”
