Impeachment Of Fmr Kogi Dep-Gov Was ‘Constitutional Coup’ – Court

The Chief Judge of Kogi State was under focus on Thursday after a State High Court in Lokoja declared the removal of Simon Achuba, the former Kogi deputy governor by the State House of Assembly as null and void.

Justice John Olorunfemi said Achuba’s removal from office by the Assembly was a constitutional coup and that the nomination of Edward Onoja as the deputy governor, did not follow due process

The Chief Judge who constituted the panel that acquitted Achuba, however, shocked many when he appeared to inaugurate Onoja as Achuba’s successor despite the acclaimed acquittal of the former deputy governor of all charges leveled against him by the State House of Assembly.

Justice Olorunfemi affirmed that the action of the House of Assembly was contrary to Section 188 subsection 8, which stipulated that the Assembly should not proceed with any further action against the deputy governor given his exoneration by the panel.

Achuba who had fallen out with Governor Yahaya Bello was impeached and removed from office by the Kogi State House of Assembly in October 2019 a month to the election that returned Bello to office for a second term.
