Court Adjourns Impersonation Case Against Asaba Businessman

An Asaba High Court has adjourned the trial of an Ogwashi- Uku, Delta State based businessman, Mr. Collins Afuwa to October 20, 2020.

He was arraigned before Justice M Omovie on a five count charge of impersonation, disobedience to law, provoking breach of peace by offensive publication among others.

In count one, the defendant was arraigned for impersonation punishable under section 484 of the Criminal Code Act Cap 38 laws of the Federation 2004 as applicable in Delta State.

According to the particulars of offence, Collins Uche Afuwah between July 2010 and September 2019 at Ogwashi-Uku and Asaba within the jurisdiction of the  High Court presented himself as the Iyase of  Ogwashi – uku and as a person lawfully installed, crowned and  performed the duties of such within Ogwashi – Uku and Asaba.

In Count two, the defendant was alleged to have paraded himself as the Iyase of Ogwashi -Uku, exercising and discharging the powers and duties of Iyase of Ogwashi – Uku within OgwashiUku Asaba an act he was restrained from by the Court of Appeal judgement dated 12th July 2020 at appeal no CA /B/94/2009 and Supreme Court judgement dated 14th December 2018 of suit SC.55/2011.

When the charges were read in court, the Defendant pleaded not guilty to the five count charge.

The lead Counsel to the defendant made an oral application for bail for the defendant which was opposed by the claimant’s legal team but over ruled by the court on the ground that they were bailable offences.

The bail application was then granted by the trial judge, Justice M Omovie but with conditions which included two sureties of a public officer not below salary grade level 12 and one million naira in like sum. The trial Judge, Justice Omovie then adjourned the case to the 20th of October, 2020, for further trial.
