The crisis in the All Progressives Congress, APC was at the weekend taking another turn for the worse after elements aligned to the erstwhile national chairman of the party, Comrade Adams Oshiomhole went to court to reclaim leadership from the Governor Mai Mala Buni led Caretaker/Extraordinary National Convention Planning Committee.

The men led by the erstwhile National Vice-Chairman, South-South, Ntufam Hilliard Eta are seeking a declaration of court to sack the Buni led leadership.

They are also asking the court to compel the Independent National Electoral Commission INEC to give recognition to Eta as the acting National Chairman of the APC.

Eta had taken position as acting national chairman following the court ordered suspension of Oshiomhole at the peak of the struggle for the leadership of the party at the beginning of the year.

Eta’s position was, however, disputed by another faction of the leadership led by Chief Victor Giadom.

Giadom had as acting national chairman convened a National Executive Committee, NEC meeting in the presidential villa with President Muhammadu Buhari in attendance where the Oshiomhole led National Working Committee, NWC was dissolved and the Buni led caretaker committee was installed.

However, Eta has now gone to court to reverse the decisions.

In the suit filed on his behalf at the Federal High Court, Abuja through his lawyer, Dr Onyechi Ikpeazu SAN, he asking the court to determine whether “having regard to Section 183 of the Constitution of the Federal Republic of Nigeria 1999 (as amended) and Article 17 (iv) of the Constitution of All Progressives Congress (APC) it is an illegality and a void act for a person to hold an executive office in the Government simultaneously with an office in any organ of the All Progressives Congress (APC) at any level, in whatever capacity”.

The defendants in the suit are Gov. Buni, the National Secretary, Sen. John Akpan Udoedehe, Gov. Isiaka Oyetola of Osun, Gov. Sani Bello of Niger, Stella Okotete (all members of the caretaker committee) and the Independent National Electoral Commission INEC.

He is also seeking a declaration from the court to find the suitability of Governor Buni hold a position as an official of a political party while at the same time serving as governor taking consideration to Section 183 of the Constitution of the Federal Republic of Nigeria, Articles 20(i)(a), 17(i) and (iv) of the Constitution of the All Progressives Congress (APC).

Eta is as such seeking an order “setting aside and nullifying the meeting purportedly summoned on behalf of the All Progressives Congress on 25th day of June, 2020, at the Presidential Villa, Abuja as well as all decisions reached therein”.
