Court Stops PDP From Acting On Suspension Of Orbih By Obaseki’s Stakeholders
A High Court in the Federal Capital Territory has granted an injunction restraining the Peoples Democratic Party, PDP from acting on the purported suspension of the National Vice Chairman of the party, Chief Dan Orbih by a group of party stakeholders aligned to Governor Godwin Obaseki of Edo State.
The court order obtained by Chief Orbih restrains the PDP from acting on the resolution of a group of party stakeholders styled as Edo North Stakeholders who met and resolved to suspend Orbih, the national vice-chairman of the party. The purported suspension was allegedly ratified by a group of state leaders who met under the leadership of Governor Obaseki and gave vent to the purported suspension.
Orbih who was chairman of Obaseki’s re-election campaign in a motion filed before Justice O. A. Adeniyi, has, however, asked the court to compel the PDP not to act on any such order which he said is at variance with Article 57(1)-(7) which spells out the procedure for the suspension of a national officer.
Following the application of an interim injunction by Orbih filed on October 13, 2021, through his counsel, M.O. Onyilokwu Esq. Justice Adeniyi ruled thus:
The court in its preliminary order in the unfolding battle between Obaseki and his erstwhile campaign manager, Orbih, ruled thus:
IT IS HEREBY ORDERED
Accordingly, Interim Order of injunction is hereby made restraining the Defendant, at any level of its organs or its servants, agents, officers, or howsoever described, from giving effect to, recognizing or acting upon the resolution of a group calling itself Edo North Leaders/Stakeholders of the Defendant made on October 7, 2021 purporting to suspend the Applicant from the party and which resolution was purportedly ratified by the Edo chapter of the Defendant without due consideration to the provisions of Article 57(1)-(7) of the Constitution of the Defendant, pending the hearing of and determination of the motion on notice.
This order shall be served on the Defendant forthwith and the motion on notice, filed on 13/10/2021 is hereby set down to 21/10/2021 by 2 pm prompt for hearing.
The purported suspension of Orbih now stopped by the court was made by a group of party stakeholders in Edo North and ratified at a meeting of state leaders convened by Obaseki.
