Ayade defection judgment

Ahead of Thursday’s judgment by a Federal High Court in Abuja over his defection from the People’s Democratic Party (PDP) to the All Progressives Congress (APC), Cross River State Governor, Prof Ben Ayade has expressed his belief in the Nigerian judiciary.

The governor spoke ahead of the day’s judgment following the court action filed by the PDP demanding the governor’s exit following his defection from the party to the APC.

Ayade in a statement issued in Calabar and signed by his Special Adviser on Media, Mr Christian Ita, said his faith in the judicial system to do what is right, fair and just is unwavering and beyond doubt.

“I believe in the judiciary, I believe today’s judgement will be fair, I believe that justice will not only be done but will be seen to have been done. Whatever the outcome I will accept but without prejudicing my right of appeal should it become imperative,” Ayade was quoted in the statement as saying ahead of the judgment on his defection.

The PDP, through its counsel Emmanuel Ukala, SAN, had filed the suit marked: FHC/ABJ/CS/975/2021 before Justice Taiwo to seek for an order sacking the governor and his deputy over their defection to the All Progressives Congress (APC), among others.

NAN reports that Taiwo had, earlier, ordered two House of Representatives members representing Cross River and 18 lawmakers from the state’s House of Assembly to vacate their seats over their defection to APC.

The judge gave the order following a suit marked: FHC/ABJ/CS/971/2021 filed on Aug. 27, 2021, by the PDP to challenge the 20 lawmakers’ defection to APC, alongside the governor on May 20, 2021.

Justice Taiwo, in the judgment, dismissed the defence argument that the PDP (plaintiff) had no locus standi (legal rights) to institute the case.

He also dismissed other preliminary objections raised by the sacked lawmakers.
