Law Firm Puts EFCC To Task On Retrieving Lagos Property From Italian Lady

The Economic and Financial Crimes Commission, EFCC has been taken to task over the delay in getting an Italian lady, Mrs Floriana De Stefani convicted of taking over the property of a Nigerian company in the highbrow area of Ikoyi, Lagos in returning the property despite a court order.

Delphi Law Advisory, lawyers to Waterside Properties Ltd in the petition dated December 24, 2023 addressed to the Zonal Commander, Economic and Financial Crimes Commission, EFCC, Awolowo Road, Lagos alleged that Ms De Stefani had failed to heed the express order of court to surrender the property belonging to the company over which she was convicted.

Mrs De Stefani had been convicted for illegally converting a property belonging to Waterside Properties Ltd at No14 Warring Road, now known as Bayo Kuku Road following prosecution by the EFCC.

In the letter to the EFCC written on behalf of Delphi Law Advisory by Chijoke Okoli, SAN, the law firm expressed concern on the delay in Mrs De Stefani returning the property to Waterside as ordered within the seven day period that expired last October.

“Whilst acknowledging your having commendably prosecuted the Convict successfully as well as discretion on the details of prosecuting accused persons and related matters, we are constrained to respectfully remind you of the following unequivocal order of the Lagos State High Court (coram Justice Dada) in its judgment of October 7, 2022:

“…the convict is hereby ordered to yield up possession of the demised property, 14A  & B WARRING/BAYO KUKU ROAD, IKOYI, LAGOS to Waterside Properties Limited within 3 weeks of this Judgment”

“This means, at the risk of an irritating emphasis of the obvious that the Convict had up until, and not later than, October 28, 2022 to yield up possession to our Client.”

While noting the seven days further extension given her following another court order on December 19, 2023, the law firm wrote:

“From the information published by your organization, the 7 days extension supposedly starts counting from December 19, 2023, meaning that the convict has until December 26, 2023 to yield possession to Our Client. That day being a public holiday  we expect that you would accordingly have your officers at the premises the following day, being December 27, 2023-by or before noon for a formal handover of the property to Our Client’s Managing Director/CEO, Mr Tonye Amachree (and other representatives of Our Client) with or without the presence of the Convict.”

Concluding, the law firm wrote:

“As we look forward to your giving strict effect to your stated objective of getting the Convict to yield possession of the property to Our Client as ordered by the Corut please remain assured our highest regards and best wishes for this season of goodwill.”
