Appeal Court Rules Against Ex-Kogi Gov In Yahaya Bello Vs EFCC Case

The Court of Appeal has overturned the Lokoja High Court’s order to commence contempt proceedings against the Economic and Financial Crimes Commission (EFCC) and its Chairman, Ola Olukoyede at the instance of former Kogi State Governor, Alhaji Yahaya Bello.

Presided over by Justice Joseph O.K. Oyewole, the Court of Appeal granted EFCC’s motion for a stay of execution and proceedings in the contempt case, pending before the Kogi State High Court.

The court deemed the motion ex parte meritorious and scheduled the hearing of the motion on notice for May 20, 2024.

Additionally, it directed substituted service of all case processes to be affixed at Yahaya Bello’s last known address in Abuja.

Consequently, the appellate court’s ruling suspended the contempt proceedings against EFCC and its chairman, enabling the anti-graft agency’s appeal against the Lokoja High Court’s decision to move forward.

The case bears reference EFCC vs. Alhaji Yahaya Bello, Appeal No: CA/ABJ/CV/413/2024.
GWG.ng reports that the move is a respite for the EFCC and its chairman given the discord that was stoked by the moves of the commission to prosecute Alhaji Yahaya Bello over alleged cases of misappropriation claimed by the anti-graft agency.
