Court Action Starts To Stop Removal Of Umar As CCT Chairman
President Bola Tinubu, Attorney-General of the Federation and Minister of Justice, Lateef Fagbemi, and Senate President Godswill Akpabio are facing legal action in the Federal High Court in Abuja. The case concerns the alleged unlawful removal of Justice Danladi Umar as Chairman of the Code of Conduct Tribunal (CCT).
The lawsuit was filed by two civil society organizations, the Community Rescue Initiative and Toro Concerned Citizens Relief Foundation, along with Abuja-based lawyer Comrade Nasir Bala.
The plaintiffs are requesting the court to prevent the Clerk of the National Assembly from transmitting the resolution passed by both the Senate and the House of Representatives, which removed Umar from office, to President Tinubu.
They are also asking the court to stop the President from acting on the resolution, claiming that the process violates clear provisions of the 1999 Constitution. In their motion, they argued that the actions taken were “illegal, void, unconstitutional, and of no effect.”
The case, filed under the number FHC/ABJ/CS/1796/2024, is being represented by legal professionals Mahmoud M. Maidoki Esq., A.G. Salisu Esq., Jibrin S. Jibrin Baq., and Abubakar S. Idris Bag. The plaintiffs are challenging the removal of Umar, arguing that the process violated constitutional provisions. They are seeking the court to determine whether the removal “was illegal, void, unconstitutional, and of no effect” and if the actions of the National Assembly breached key sections of the 1999 Constitution.
The plaintiffs also want the court to rule that any subsequent appointment of a new CCT Chairman is invalid. They argue that such actions “were done in clear breach of the applicable provisions of the 1999 Constitution and the Code of Conduct Tribunal Act.”
Justice James Omotosho, who is overseeing the case, has ordered that the process be served via substituted means, including posting the notice at the court’s notice board, the APC secretariat, and the Office of the Secretary to the Government of the Federation. The court has scheduled the hearing for January 14, 2025.
