Defection: PDP Piles Pressure On Ibori’s Daughter, Takes New Action
The Delta State chapter of the Peoples Democratic Party (PDP) has filed a lawsuit against Rep Erhiatake Ibori-Suenu, the representative of Ethiope Federal Constituency, at the Federal High Court in Warri.
The PDP is asking the court to declare the seat occupied by Ibori-Suenu vacant following her defection to the All Progressives Congress (APC).
The case, filed under suit number FHC/WR/CS/126, was initiated by the PDP’s legal team, led by Dr. Ayo Asala, SAN. The party is urging the court to interpret Section 68(1)(g) of the 1999 Constitution, which addresses the status of lawmakers who switch parties, and declare Ibori-Suenu’s seat vacant.
The court action names Ibori-Suenu, the Speaker of the House of Representatives, the House of Representatives itself, and the Independent National Electoral Commission (INEC) as defendants.
The PDP is seeking the following declarations and orders from the court:
1.That Ibori-Suenu, having defected from the PDP (which sponsored her election) to the APC, should vacate her seat in line with Section 68(1)(g) of the Constitution.
2.That the Speaker, the House of Representatives, and INEC are obligated to declare her seat vacant due to her defection.
3. An order declaring the Ethiope East/West Federal Constituency seat vacant and directing Ibori-Suenu to vacate the seat immediately.
4. A permanent injunction preventing Ibori-Suenu from continuing to represent the constituency or performing any legislative duties since her defection has invalidated her seat.
5. An order mandating INEC to conduct a by-election to fill the vacancy left by her defection.
6. An order requiring Ibori-Suenu to repay all salaries, allowances, and benefits she has received as a member of the House of Representatives since her defection.
The PDP aims to enforce constitutional provisions regarding party defections and ensure that legislative seats in the National Assembly are occupied in accordance with the law..
