Court Asked To Sack Rivers State Sole Administrator

A Federal High Court in Abuja has been asked to nullify the appointment of Vice Admiral Ibokette Ibas (rtd) as the Sole Administrator of Rivers State, arguing that the move violates the Nigerian Constitution.

The legal action, initiated by lawyer Johnmary Jideobi, lists President Bola Tinubu as the primary defendant, alongside the Attorney-General of the Federation and the attorneys-general of the 36 states. The lawsuit seeks to overturn Ibas’ appointment and nullify all decisions made under his leadership.

The plaintiff is urging the court to declare that the President lacks the constitutional power to suspend or remove an elected governor and replace them with a Sole Administrator. He also seeks an injunction preventing any such appointments in the future..

At the heart of the case is the March 18, 2025, suspension of the Rivers State Governor and Deputy Governor, which paved the way for Ibas’ appointment. The plaintiff contends that these actions are unconstitutional and should be reversed.

In the court documents, the plaintiff questions whether the President has any legal authority to interfere with the tenure of elected state officials. He argues that the Constitution provides no such powers, warning that allowing this precedent to stand could undermine Nigeria’s democratic framework.

No date has been set for the hearing of the case.
