Court Clears Naira Marley, Sam Larry In Mohbad’s Death Case

A court in Lagos has ruled that the state government is not required to prosecute Naira Marley and Sam Larry in connection with the death of the late singer, Mohbad.

The decision was made by a High Court in Ikeja after Mohbad’s father, Joseph Aloba, filed a case against a previous legal decision that cleared both Naira Marley and Sam Larry of any wrongdoing.

In his judgment on Wednesday, Justice Olatokun said that the Attorney General of Lagos State has full power to decide whether or not to prosecute someone and that this decision cannot be challenged in the court.

“The Attorney General’s discretion in criminal matters, as provided under Section 211 of the Constitution, is sacrosanct,” the judge ruled.

Following the court ruling, the lawyer representing Mohbad’s family, Wahab Shittu (SAN), said they were not satisfied with the outcome. He confirmed that they would take the case to the Court of Appeal.

“Our interest is not to indict anyone. We are simply seeking justice for Mohbad. We will continue this fight at the appellate level,” Shittu said.

Earlier in February, a Magistrate Court in Yaba had also cleared Naira Marley, Sam Larry, and another individual known as Primeboy of any involvement in Mohbad’s death. That decision also relied on the advice from the Directorate of Public Prosecutions (DPP), which found no case against them. Mohbad’s former manager, Opere Babatunde, was also cleared.

However, the DPP advised that two people should be charged. One is Feyisayo Ogedengbe, the nurse who gave Mohbad treatment before he died. The other is Ayobami Sadiq, a close associate of the singer. They are now set to face trial for reckless and negligent acts, based on Section 251(e) of the Lagos State Criminal Law of 2015. Their case will be heard at the Magistrate Court.

Mohbad, who used to be signed to Marlian Records, passed away on September 12, 2023. His death caused a lot of anger and sadness across the country. Before he died, Mohbad had spoken out about being threatened and physically attacked by people connected to his former music label, which included Naira Marley and Sam Larry.

After Mohbad’s passing, videos and social media posts began to surface, pointing fingers at Naira Marley and Sam Larry. These led the Lagos State Police to arrest Sam Larry, Naira Marley, and other suspects while they waited for the results of the autopsy and more investigations.

The latest court ruling has upset many people. Critics believe that justice is not being served fairly, especially since high-profile individuals like Naira Marley and Sam Larry have been let go while others are being prosecuted. Civil rights groups and fans are still calling for a full and honest investigation into what really caused Mohbad’s death.
