Bayelsa: APC In Quandary As Disqualification Papers Are Served
An Abuja High Court has served the All Progressives Congress (APC), its deputy governorship candidate, Degi Eremienyo copies of the rulling disqualifying him as the running mate to Chief David Lyon, Bayelsa APC governorship candidate.
The court had on Tuesday ruled in favour of the Peoples Democratic Party (PDP) in a suit number, FHC/ABJ/CS/1101/2019 challenging the veracity of the information supplied by the second defendant to the Independent National Electoral Commission (INEC).
The summon alleged that there were discrepancies in the educational documents supplied to the INEC by the deputy governorship candidate contrary to the relevant provisions of the Electoral Act 2010 (as amended).
The following names, qualifications and dates were supplied on form CF-001 affidavit in support of his personal particulars :Biobarakumo Degi-Eremienyo, Degi Biobaragha, Degi Biobarakuma, Adegi Biobarakuma and Degi- Eremienyo Biobarakuma Wangagha.
The PDP thereby asked the court to disqualify the second defendant based on the alleged false information supplied to the INEC, which is contrary to the relevant section of the 1999 Constitution and Electoral Act 2010 (as amended).
Mr. Eremienyo according to the plaintiff, is not eligible to hold any political office in the country.
In his ruling, the presiding judge, Justice I.E Ekwo ruled as follows: that the third defendant cannot present official documents, and or educational certificates to the first and second defendants in the following variations:
Biobarakumo Degi-Eremienyo, Degi Biobaragha, Degi Biobarakuma, Adegi Biobarakuma and Degi- Eremienyo Biobarakuma Wangagha.
Therefore, he is not qualified to run as the running mate to the governorship candidate of the APC.
“Mr. Eremienyo, by the reason of the third defendant presented false information to the second defendant, INEC in support of his nomination contrary to section 31 sub section 5 and 6 of the 2010 Electoral Act (as amended) and hereby stands disqualified.”
