The Supreme Court has nullified the conviction of Senator Orji Uzor Kalu, the penultimate governor of Abia State over allegations of fraud amounting to N7.65 billion while he was governor.

The conviction was handed down by Justice Mohammed Idris of the Federal High Court sitting in Lagos in December, 2019. The conviction has led to the absence of Kalu from the Senate since that judgment. He is the Senate Majority Whip.

The Supreme Court in a judgment on Friday ordered the Chief Judge of the Federal High Court to assign the case to another judge for a fresh trial.

The apex court’s decision was upon the technicality that Justice Idris was already a Justice of the Court of Appeal by the time he delivered the judgment.

The apex court ruling also affected Uche Udeogu, the former director of finance Government House, who was convicted along with Kalu by the Federal High Court.

The case against Kalu and Udeogu was brought by the Economic and Financial Crimes Commission, EFCC.
