A move to stop the All Progressives Congress, APC from screening Pastor Osagie Ize-Iyamu for the Edo State governorship primary suffered a setback on Monday.

Justice Vestee Eborieme of the Edo State High Court sitting in Abudu, delayed hearing on the motions filed   by Ken Mozia ( SAN) that would have restrained the APC from conducting its internal primary in the state and screening Ize-Iyamu till Tuesday, June 2nd.

The ex-parte motion would have also restrained the APC from conducting  the party primary as prescribed by the National working Committee  of the APC.

The legal team was, however, stunned when legal representatives of all three defendants including the All Progressives Congress; Comrade Adams Oshiomhole; and Pastor Osagie Ize Iyamu, all made an early appearance in court and demanded to be served a notice for trial.

The move rendered the need for an ex parte judicial proceeding futile and without purpose.

Faced with the counter from the APC lawyers, Justice Eborieme postponed hearing on the case to Tuesday despite the insistence of the applicants for the exparte motion to be heard.
