Ex Miss Nigeria, Wins 50% Of Late Husband’s Assets

In a landmark decision, the Federal High Court sitting in Lagos has declared that a famed former Miss Nigeria, Helen Prest-Ajayi, is entitled to 50 percent of the net assets of the late Dr Tosin Ajayi.

 GreenWhiteGreen GWG reports that the late Dr. Tosin Ajayi was married to the former Miss Nigeria in the last 35 years of his life having been separated from his first wife, Mrs. Oluwayemisi Ajayi with whom he was separated in that period.

The burial of the famed medical doctor and owner of First Foundaiton Hospital, Lagos was steeped in controversy in 2020 when the first wife and the second wife prepared different funeral brochures at the burial.

In a ruling on Tuesday in a suit filed by Miss Tomisin Ajayi and Mrs Helen Prest-Ajayi as the first and second applicants, filed through their counsel, Mr Abiodun Owonikoko (SAN), Justice Tijjani Ringim affirmed that the applicants were entitled to 50% of the assets of the deceased.

The four respondents in the case were the First Foundation Medical Engineering Company Limited; Registrar-General of the Corporate Affairs Commission; Mrs Oluwayemisi Ajayi; and Mr Patrick Abak, a lawyer.

The judge in his ruling granted the 13 reliefs sought by the applicants, the former Miss Nigeria, Helen Prest-Ajayi and her daughter, as the respondents’ failed to counter the deposition by the applicants.

The applicants had pleaded that they were “entitled to 50 per cent (or so much as the court may sanction upon audit and valuation) constituting the net assets of the firm, after satisfying all just taxes and debts as family and investment partner of Dr Tosin Ajayi from 1996 till 26 April, 2020 to the exclusion of Mrs Oluwayemisi Ajayi, among others.

Justice Ringim also held, “Despite the service of processes filed on the respondents and affidavits of service duly filed in court, the respondents failed to use the opportunity afforded to them by law to controvert the averment of the plaintiff in the affidavits.

“However, it is a settled law that evidence not controverted is deemed admitted. All the reliefs sought in this application are hereby granted as prayed.”

GreenWhiteGreen GWG reports that Miss Prest Ajayi won the Miss Nigeria contest in 1979 at the age of 19 and five years later entered into a relationship with the late Dr Ajayi reportedly with a traditional marriage that followed after.
