Edo PDP Candidates’ List: New Options For Obaseki And Orbih Factions

Options for the two factions of the Peoples Democratic Party, PDP in Edo State following the controversy that arose over the interpretation of the Court of Appeal judgment on the candidates’ list have emerged.

GWG.NG reports that the Court of Appeal had in its judgment released last Friday struck out the appeal filed by the Dan Orbih led mainstream faction upon the fact that the judgment of the lower court was not fully transmitted to the appellate court.

A Benin Federal High Court had upon a suit filed before it by the Governor Godwin Obaseki led faction of the party given recognition to its list of candidates as against the Orbih led faction that had originally been recognised by the Independent National Electoral Commission, INEC.

INEC based its recognition of the Orbih led list of candidates upon the fact that it monitored the congresses conducted by the faction.

However, despite affirming the appeal of the Orbih faction as meritorious, the appeal was struck out on the claim that the record of proceedings at the lower court was not fully transmitted to it.

The description of the appeal as meritorious while being struck out has stoked controversy in Edo State with both sides claiming victory.

Sources in the Obaseki and Orbih factions close to GWG.NG affirmed that both sides are now weighing their options.

A concerned Nigerian who posted on a Benin, Edo State whatsapp platform was explicit on the options for the two sides.

He said:

“The said judgement ctc is in public domain. The court struck out the Appellants’ case. Therefore it is implicit that the existing Federal High Court Judgement that was appealed subsits.”

“In this situation only two options are available to the Appellants, file for the case to be relisted at the Court of Appeal, or appeal the ruling to the Supreme Court.”

For the Obaseki faction in Edo PDP, the options are to also appeal the case to the Supreme Court that it should have been dismissed instead of being struck out as the decision of the Court of Appeal gives hope to the Orbih led faction to relist the case based on the fact that it has the INEC recognition for its primaries and candidates.
