The Court of Appeal in Abuja has invalidated the election victory of Kaduna State House of Assembly Speaker, Hon Yusuf Liman, ordering a rerun in five polling units within the Makera State constituency. The decision followed the nullification of Liman’s victory by the Kaduna State Assembly Election Petitions Tribunal on September 30, 2023, which originally mandated a rerun in 42 polling units.

Solomon Katuka of the Peoples Democratic Party (PDP) had contested Liman’s victory, alleging substantial irregularities and claiming he was the rightful winner of the March 18, 2023, House of Assembly Election in Makera constituency.

The affected polling units specified for rerun by the Appeal Court are 37 PUs in Makera ward, two PUs in Barnawa ward, one PU in Kakuri Gwari ward, one PU in Television ward, and one PU in Kakuri Hausa ward, totaling five polling units.

Dissatisfied with the Tribunal’s decision, both the APC candidate and the Independent National Electoral Commission (INEC) appealed the ruling. In a judgment delivered on Friday, November 24, 2023, in Abuja, the Appeal Court, led by Justices O. O Adejumo, A. O Oyetula, and P. A Obiora, dismissed the appeal by the Speaker and INEC, ordering a rerun in five specific polling units, rather than the initially mandated 42.

The identified polling units for rerun within the Makera State Constituency as directed by the appellate court, include Barnawa ward PU 005 and 009, Kakuri Gwari PU 006, Television Ward PU 022, and Kakuri Hausa Ward PU 045. The current vote tally stands with the APC at 17,470 votes and the PDP at 17,088. The court justified the nullification of Liman’s election based on a 382-vote margin, which fell below the number of Permanent Voter Cards collected in the mentioned polling units.
