The Supreme Court has ruled that Senator Samuel Anyanwu is the rightful National Secretary of the Peoples Democratic Party (PDP).

In a significant judgment on Friday, the apex court overturned the earlier decision of the Court of Appeal in Enugu, which had ruled against Anyanwu in the dispute over his position in the party.

The Supreme Court upheld the argument presented by Anyanwu’s legal team, stating that both the trial court and the Court of Appeal lacked the authority to interfere in the case, as it involved the internal affairs of the PDP.

Two weeks ago, the Supreme Court had reserved its ruling on Anyanwu’s appeal, in which he sought to reverse the judgment of the Court of Appeal in Enugu. The lower court had upheld an earlier ruling by the Federal High Court that removed Anyanwu from office and recognized Sunday Udeh-Okoye as the legitimate PDP National Secretary.

The lower courts had ruled that Anyanwu had automatically resigned from his position when he contested the 2024 Imo State governorship election as the PDP candidate. However, Anyanwu countered this, arguing that the PDP constitution provides a four-year tenure for its officers and that the court had misinterpreted Section 84(12) of the Electoral Act 2022, which requires public officeholders to resign before contesting elections.

With this latest ruling, Anyanwu has been reaffirmed as the National Secretary of the PDP, bringing an end to the legal battle over the position.
