Umahi Escapes As Appeal Court Dismisses APC Candidate’s Suit To Sack Him

The Court of Appeal sitting in Enugu, Friday dismissed the suit filed by the candidate of the All Progressives Congress, APC, Ebonyi State, in the 2019 Governorship election, Senator Sonni Ogbuoji and his Deputy, Chief Justin Ogbodo Mbam, which had sought the Court’s nod to sack Governor David Umahi and his Deputy, Dr Kelechi Igwe on account of their defection from the Peoples Democratic Party, PDP to the APC.

It would be recalled that the Ebonyi State High Court sitting in Abakaliki had on Tuesday, February 28, 2022, struck out the same suit and awarded N500, 000 as damages against the plaintiff.

The plaintiff had upon the judgment appealed to the Court of Appeal which again refused the prayer to sack Governor Umahi from office.

In a 37 minutes ruling, the lead Judge, Justice A.O Belgore said that the suit was struck out on the claim that it was inconsistent with the constitution and extant laws of the country.

However, about two weeks later, a Federal High Court sitting in Abuja in another suit against Umahi, his deputy and 16 lawmakers sacked them from office for defecting from the PDP to the APC. The judge in his ruling affirmed that the votes upon which they came to office belonged to the PDP.
