Fake Lawyer Nabbed After Appearing Before Magistrate, Opening Law Office

James Kimathi Muthuri, a Kenyan, has been detained and charged with impersonation following a raid on his ‘law office’ by the Law Society of Kenya (LSK).

A Meru court has now ordered the defendant to be held in police detention for one year for engaging in legal practice without a license following his arriagnment in court.

The suspect pleaded ‘not guilty’ to the accusation when he appeared before Tigania legal Court Magistrate Rose Ongila on Tuesday, April 18, 2023. He claimed he works in his uncle’s legal office and is still seeking a law degree.

The office, according to LSK, showed up on their list of law firms in Kenya.

Marias Maranya, the attorney for the LSK, stated;

“Muthuri has been masquerading as an advocate and indeed appeared before court number 3 and represented clients when he knows he is not qualified. He even had the audacity of opening a law office in a market called Muriri but when LSK officials raided the office to seek the licences, the man literally took off”

The case was set to be heard in another court on May 2, 2023, because the suspected phony lawyer appeared before Magistrate Rose Ongila as an attorney in all of his cases.

The magistrate excused herself from the hearing, claiming that she was a potential witness or person of interest. She stated:

“The accused person appeared before this court on March 28, 2023, acting as an advocate. It is clear from the above that I cannot hear or make any decision on the matter since potentially am a witness…so to promote fair hearing I recuse myself from handling this matter.” The suspect was denied bail and will be held for 14 days.
