Presidential Poll: INEC Tells Tribunal It Does Not Have Server

The Independent National Electoral Commission, INEC, has denied the existence of servers used for the conduct of the recent presidential election. It has, therefore, said that Atiku Abubakar’s prayers to the Presidential Election Tribunal to inspect one was as such untenable.

The response of the commission was upon the request by Atiku Abubakar, the presidential candidate of the Peoples Democratic Party, PDP to inspect the acclaimed server used by the commission in transmitting the results of the February 23 presidential election.

INEC in its counter affidavit presented by its lawyer, Mr. Yunuz Usman, SAN to the Justice Mohammed Garba led tribunal as such called for the dismissal on the prayer on the server.

“My lords the petitioners are simply testing the waters with both legs. They are asking us to bring something we don’t have”, the election management body submitted on Thursday.

INEC was submitted in its submission by lawyers to the All Progressives Congress, APC and President Muhammadu Buhari.

The APC lawyer Prince Lateef Fagbemi, SAN in his submission prayed the court not to grant a relief that it could not enforce.

“The court should be wary of making an order which is incapable of being executed. 

“INEC which is the electoral body is saying they don’t have what the petitioners are requesting for.”

The PDP and its candidate had repeatedly asserted that the proof of their victory in the presidential election could be found in the servers of the commission.
