Court Sacks Ondo APC Rep Candidate In Akoko
The Federal High Court in Akure, the Ondo State capital, has declared the primary election of the All Progressives Congress (APC) for the Akoko Southeast and Southwest Federal constituency null and void.
The court thereby disqualified Hon. Adegboyega Adefarati, the party’s candidate for the February 25th general election.
The judgement was delivered by Justice T.B Adegoke in response to a suit brought before the court by Mr. Segun Ategbole, an aspirant in the primary election, who alleged infractions in the process and sought to be declared the winner.
The court ruled that the party cannot put something upon nothing and expect it to stand.
The judgement also declared that APC has no candidate for the House of Representatives in the 2023 Election, as no valid primary election was held by the party.
The court further restrained the party from conducting any primary election, as the window has closed, having been shorter than the 180 days allowed by the Electoral Act 2022.
INEC was also barred from accepting the name of the 3rd Defendant, the Plaintiff, or any name whatsoever from APC.
The court equally restrained the 3rd Defendant, Mr. Gboyega Adefarati, from parading himself as the candidate of APC for the February 25th, 2023 Election.
In response to the judgement, the APC in the state rejected the verdict and vowed to challenge it at the Appeal Court.
In a statement by its publicity secretary, Alex Kalejaye, the party expressed its grave concern over the development and directed its lawyers to file a stay of execution of the judgement.
The party assured members and residents of the federal constituency that it would challenge the judgement at the Appeal Court, with the view to securing a favorable judgement.
