Court on national lottery act 2005

The Supreme Court has ruled that the National Lottery Act of 2005, passed by the National Assembly, is invalid.

In a unanimous decision on Friday, a panel of seven justices determined that the National Assembly does not have the constitutional power to legislate on matters related to lotteries and games of chance.

The court clarified that the power to regulate lotteries rests solely with the state Houses of Assembly. As a result, state governments now have the exclusive authority to manage and oversee lotteries and similar activities within their jurisdictions.

Justice Mohammed Idris, who delivered the lead judgment, explained that the National Lottery Act 2005 will no longer apply in the states. However, it will still be relevant in the Federal Capital Territory (FCT), where the National Assembly holds legislative authority.

This decision follows a lawsuit filed in 2008 by Lagos State and several other states challenging the Act. Further details will follow….
