Fubara Amaewhule's Faction

Rivers State Governor, Siminalayi Fubara, has firmly stated that his administration will not recognize the Martin Amaewhule-led faction of the state House of Assembly.

This decision comes despite a plea from the Rivers National Assembly Caucus, who visited Amaewhule in Port Harcourt on Monday. During the visit, the caucus urged Fubara to enforce the Court of Appeal’s ruling, which affirmed Amaewhule and 26 others as the legitimate lawmakers in the state.

In a statement signed by lawmakers Kingsley Chinda, Senator Barinada Mpigi, and Dumnamene Dekor, the group accused Governor Fubara of misrepresenting facts. They also criticized Senior Advocate, Femi Falana, for allegedly distorting court rulings. The lawmakers expressed their concern, saying, “We wish to caution Mr. Femi Falana (SAN), to stop misinterpreting court judgments. It is regrettable that a very senior lawyer of his status will be amplifying falsehood from non-lawyers and political merchants.”

They further alleged that Falana had lied about the ruling of Justice J.K. Omotosho and the supposed defection of the 27 lawmakers, which they claimed never took place. The lawmakers stated, “Falana lied about the dates of the judgment of Justice J.K. Omotosho and the purported defection that never took place, with the intention of misleading the public.” They emphasized that the judgment, which had been affirmed by both the Court of Appeal and the Supreme Court, is final and effective. “Any attempt to deal with any other person or forum as the Rivers State House of Assembly is contemptuous of the judgment of the Supreme Court,” they said.

In response, Amaewhule expressed his dissatisfaction, saying, “The governor should know that we are not sleeping. We are aware of the hundreds of billions of taxpayers’ monies that are missing today, that are not accounted for. A day of reckoning will come.”

Rivers State’s Commissioner for Information and Communications, Joseph Johnson, reacted to the accusations by dismissing them as misleading. He insisted that Amaewhule’s faction ceased to be legitimate lawmakers after defecting from the PDP to the APC on December 11, 2023. According to Johnson, “The judgment of Justice Omotosho, which was affirmed by the Court of Appeal, does not touch nor alter the status of Martin Amaewhule and his group of 27 as ex-members of the House of Assembly of Rivers State.”

Johnson further argued that the lawmakers’ defection automatically led to the loss of their seats. “Rt. Hon. Martin Amaewhule and 26 others lost their seats in the Rivers State House of Assembly following their voluntary defection/cross-carpeting, which happened on the floor of the House of Assembly in the full glare of the public on December 11, 2023,” he explained.

In his concluding remarks, Johnson emphasized that Governor Fubara is law-abiding and respects the court system. “The Governor of Rivers State, His Excellency Sir Siminalayi Fubara, is both law-abiding and peace-loving, and accordingly has great respect for the court of law and the Nigerian judiciary. The Governor swore on May 29, 2023, to defend the Constitution of the Federal Republic of Nigeria and the rule of law, which includes respect for the courts,” he stated.
