Bad News For Tinubu, APC, As Court Gives Go Ahead For Forgery Suit

A move to stop the forgery suit raised against All Progressives Congress, APC presidential candidate, Asiwaju Bola Tinubu at the Federal High Court in Abuja was on Monday dismissed as the judge insisted on proceeding with the trial without the interlopers.

GWG.NG reports that a factional group in the Action Alliance (AA) had filed to be joined in the suit instituted by the mainstream of the party, against Tinubu and the Independent National Electoral Commission, INEC over the qualification of Tinubu to contest.

The court action originally filed by AA in June had alleged among others that Tinubu committed forgery in 1999 when he allegedly presented a forged University of Chicago certificate as part of his qualifications to be governor of Lagos State.

Following the filing of the case, a group within the AA led by Adekunle Rufai Omo-Aje that they were also officials of the party and were not taken into consideration in filing the case against Tinubu.

They had as such asked the Federal High Court to be joined in the suit as they raised opposition to the case.

However, ruling in the application by the Omo-Aje faction to be joined in the suit, Justice Obiora Egwuatu threw out the request on the grounds that conditions precedent for such joinder to be granted were not placed before the court.

Justice Egwuatu held that the Omo-Aje faction did not establish its claim as National Chairman of the AA and also did not disclose how his interest would be jeopardized if not joined as a defendant in the suit.

Justice Egwuatu as such dismissed the joinder request and held that the group was a meddlesome interloper and busybody and had not shown how its interests would be affected.

Justice Egwuatu said Adekunle Rufai Omo-Aje and Ambassador Suleiman Abdumalik who filed the joinder application on behalf of their faction failed to satisfy the conditions on why they should be joined.

GWG.NG reports that the AA faction had in the application sought for the dismissal of the suit against APC and Tinubu on the ground that they (as officers of the party) did not give the go-ahead for the suit to be instituted in the name of the party.
