Three men on Wednesday appeared in an Ile-Ife Magistrates’ Court in Osun for allegedly being in possession of used female underwear

The police charged Ofelola Olawuyi, 25; Ajayi Damilare, 27 and Toheeb Elugbaju, 19,  with three counts of being in possession of female underwear,  disobedience and conspiracy.

The Prosecution Counsel, Insp. Emmanuel Abdullahi, told the court that the defendants committed the offence between April 6 and April 7, at about 9 a.m. in Ile-Ife.

Abdullahi alleged that the defendants also conducted themselves in a manner likely to cause breach of peace.

He told the court that when the defendants were arrested, they could not give satisfactory answers to why they had the underwear in their possession

The prosecutor also alleged that the defendants unlawfully without excuse failed to comply with the Osun State “stay-at-home” order  by government to control the COVID-19 epidemic in the state.

The offence, he said, contravened the provisions of Section 17 (11) of the Quarantine Act Q2 Laws of the Federation, 2004, Public Health Law Cap 135, Laws of Osun, 2002.

Abdullahi said that the offence also contravened the provisions of sections 249(d) and 516 of the Criminal Code, Laws of Osun, 2002.

The defendants, however, pleaded not guilty.

Magistrate Joseph Owolawi admitted the defendants to bail in the sum of N200,000 each with one surety each in like sum.

Owolawi ordered that the sureties must swear to affidavit of means and must reside within the jurisdiction of the court.

He adjourned the case until May 15, for hearing.
